Booking Terms and Conditions

Please read the following terms and conditions carefully. You must not make any booking unless you understand and agree with the following terms and conditions. References to “us”, “the Property”, “we” and/or “our” in these booking terms and conditions shall mean Mintz Family Holdings Pty Ltd.

These terms and conditions apply to bookings you make with us over the phone, via chat, via email, in-person or online.

We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking and that person will bind all such travellers to these terms and conditions.

Check-in & Check-out

Check-in is from 3:00PM, and check-out is by 10:00AM. Late check-out may incur additional fees.

Parties and Social Gatherings

Parties, gatherings, and other social functions are strictly prohibited without prior consent.

Children

The environment is not safe for children because of the presence of livestock, dams, electric fences, and snakes. Unfortunately children are not permitted due to these safety hazards.

Pets

Regrettably, similarly to the hazards for children, the environment is not safe for your pets, and their presence is not allowed.

Visitors

Only registered guests are permitted on the property, with a maximum of four individuals
allowed unless prior approval has been obtained.

Smoking

Please note that all our accommodations are completely non-smoking. To ensure the comfort of other guests, please ensure smoking is done outside, well away from others. Please be respectful and conscious of fire danger in disposing of butts. Smoking inside will incur an additional cleaning fee of $1000.

Fire Safety & Awareness, BBQ Rules

Merilli is located in a bushfire-prone region. Guest are encouraged to familiarise themselves with local fire danger ratings and evacuate the property if safe to do so if a bushfire is threatening. we will endeavour to keep you informed should this be the case providing telecommunications are available in the area during an event.

The BBQ is only permitted to be used in the area designated.

Waste Management

Dispose of waste and recyclables in the designated bins and please follow local waste separation guidelines. Kindly remove any rubbish from the premises and place it in the appropriate bins located in the utility shed next to the parking area on departure.

Electric Vehicle Charging

No electric vehicle charging stations are currently available. Guests are encouraged to make plans in advance and identify nearby public charging facilities before their arrival and to charge during their stay.

Security Cameras

Guests are informed that two security cameras are positioned outside the cottage, allowing for monitoring of the car park and driveway areas. Additionally, there are security cameras installed in other outdoor areas of the estate to ensure the safety of livestock, machinery, and monitoring of water etc. These cameras operate 24/7 and do not record any indoor or private spaces at Merilli1885.

Off-limits Areas

For your safety, please avoid entering areas such as the fragile and fenced ruin, dams, paddocks with livestock, as well as places that are clearly locked or marked as private or restricted, including sheds and machinery areas.

Wildlife Awareness

In this rural area, there is a chance of encountering wildlife, including snakes. Guests are encouraged to stay alert and avoid tall grass; please report any sightings immediately. For your safety, we kindly request that you keep doors closed at all times to ensure wildlife does not enter indoor spaces.

Electric Fences

Some areas of the property are equipped with electric fences. Please stay within the designated cottage area to avoid accidental contact, which may cause an unpleasant mild shock.

Gates

To ensure the safety of our horses and livestock that are frequently moved between paddocks on the property, kindly leave all gates in the same position you have found them, whether they are open or closed.

Dams

Dams pose significant dangers. There are several dams on the property that are strictly off-limits. They are deep, contain submerged logs, and may occasionally have snakes swimming in them! Swimming or engaging in recreational activities in these dams is not safe.

Speed Limits

A 5 km/h speed limit applies to all vehicles on the property to ensure the safety of guests, farm workers, and animals.

Other Farm Hazards

Be aware of potential farm hazards such as moving farm machinery, livestock, and uneven terrain. Guests are responsible for their own safety and are advised to remain vigilant and alert at all times.

Water

The cottage is run entirely on filtered rainwater, water is safe to drink from all of the internal taps and available chilled from the refrigerator door. Ice is available from the automatic ice maker in the freezer and is also made from filtered rainwater. Water is a precious resource especially during summer and times of drought, as such guests are asked to use water sparingly and report any leaks immediately.

Please note the orchard irrigation is recycled waste water and the exterior taps are bore water, not to be used as drinking water.

Wastewater Plant & Treatment - BioCycle System

Wastewater is treated through a biocycle water system which is then recycled for irrigation purposes. The system is delicate so please use only the cleaning products supplied for dishwashing and to prevent blockages and environmental damage, please do not flush any foreign objects, sanitary items or no-bio degradable materials down the toilet. Use the bins provided in all bathrooms for such items.

Cancellation on Catastrophic Fire Days

We reserve the right to cancel your booking in the event of a Catastrophic Fire Danger Rating issued by the South Australian Country Fire Service (CFS). A refund will be issued in this event.

Do Not Feed Animals

As we have a strict nutritonal program in place for both our horses and livestock at Merilli we ask that you do not feed the Horses or Cattle.

For safety and their welfare please also refrain from feeding wildlife.

Do Not Pick or Eat Mushrooms

There are wild mushrooms and toadstools that crop up randomly across. the property. We cannot verify these are safe, so please do not pick and eat any fungi.

Horse Adjistment

Horse adjistment is available by prior arrangement with us. Please get in touch if you are planning to bring your horse or horses. Specific terms and conditions apply.

Our Change and Cancellation Fees

Subject to your refund and remedy rights under the Australian Consumer Law, change and cancellation fees may apply to our packages and bookings (including online bookings and bookings made over the phone, via chat, by email or in person).

Please refer back to your confirmation received at the time of booking as change and cancellation policies may differ according to the rate or package you have booked with us.

Damage & Breakages

We ask that you treat our home with the same respect that you do your own. The general rule is leave it as you found it.

If something is damaged or broken please let us know so we can attend to repairs or replacement for the enjoyment of our next guests.

Any malicious damage or theft will be reported to the police.

Travel Insurance

We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. Your insurance protection should include cover for cancellation due to illness, medical and repatriation expenses, personal injury and accident, death and loss of personal baggage and money and personal liability insurance.

Health

You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel.

Refunds

Where applicable, refunds will be processed back to your original method of payment. Please note that credit card fees are non-refundable.

Prices

All prices are subject to availability and can be withdrawn or varied without notice. The prices quoted over the phone, via chat by email or in-person are subject to change thereafter.
Availability can change at any time. All rates are GST inclusive.

Liability

To the extent permitted by law, neither the Property nor any of its related bodies corporate, directors, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law). This liability clause is subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).

Governing Law

If any dispute arises between you and us, the laws of South Australia will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of South Australia, and waive any right that you may have to object to an action being brought in those courts.

Acknowledgement

You acknowledge that you are 18 years of age or older and that you understand and agree with the above Booking Terms and Conditions and our Privacy Policy.
